After a recent probation-violating drug arrest, DMX has been denied bond and must linger in prison until he gets another crack at a hearing on Dec. 16. The date, which is two days before his 40th birthday, is the third time that the Yonkers rapper has been scheduled for court, after two delays. He was arrested for possession of Oxycontin without a prescription and has been tapped for alleged cocaine possession as well.

This arrest occurred under some severely unfortunate circumstances. Let out of a substance abuse program before completion in order a play a show in Scottsdale, Ariz., DMX consumed alcohol and was later busted with the drugs that landed him back in prison.

"I shouldn't have done it," DMX said at the time of the arrest. "I wasn't done with the program. They let me out to do the show. I should have protected myself better."

DMX, real name Earl Simmons, has become a target of the state of Arizona because of frequent felony convictions and parole violations over the years. According to the prosecutor in his current trial, Simmons has reached his last straw with the state.

"Mr. Simmons has several felony convictions, and has been given multiple opportunities to succeed on probation," reads the prosecutor's complaint. "He has been directed to treatment, as well as chose his own treatment program and continues to use illegal drugs following their opportunities."

X had been trying to make a return to music. Earlier this year, he released the single 'What You Wanna do' featuring Sean Kingston.
